Terms of Use

1. Agreement & Acceptance

By creating an account, subscribing, or otherwise using the Service, you confirm that you are at least 16 years of age (or have the consent of a parent or legal guardian) and that you agree to comply with these Terms. These Terms constitute a legally binding agreement between you and CarEditor.

2. Service Description

Car Editor is a web-based car photo editing service that uses artificial intelligence to process and transform user-uploaded images. The Service includes:

• AI-powered car photo editing and transformation
• Multiple editing tasks (paint jobs, modifications, background changes, and more)
• Image upload, processing, and download
• Free and paid subscription tiers

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Accounts & Authentication

When you first visit the Service, an anonymous account is automatically created for you via Firebase Authentication. You may upgrade this account by linking it to an email address or Google account.

• Anonymous accounts have limited functionality and may be lost if you clear your browser data
• Upgrading to an email or Google account enables persistent access and subscription features
• You are responsible for maintaining the security of your account credentials after upgrading
• You must not share your account or allow others to access the Service through your account

4. Subscriptions & Payments

Access to premium features requires a paid subscription. Subscription payments are processed by RevenueCat and Stripe.

• Billing: Subscriptions are billed on a recurring basis (weekly or yearly) at the price displayed at the time of purchase
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• Cancellation: You may cancel your subscription at any time through the Settings page or via the subscription management link. Cancellation takes effect at the end of the current billing period
• Refunds: Refund requests are handled in accordance with RevenueCat and Stripe's refund policies. Contact us at team@car-editor.com for refund inquiries
• Price changes: We may change subscription prices with advance notice. Existing subscribers will be notified before any price increase takes effect on their next renewal

5. User Content

"User Content" refers to any images, photos, or other materials you upload to or create through the Service.

• Ownership: You retain full ownership of your User Content. CarEditor does not claim any ownership rights over your images or AI-generated results
• License to us: By uploading content, you grant CarEditor a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service
• Your responsibility: You are solely responsible for ensuring that your User Content does not infringe on any third party's intellectual property rights, privacy rights, or any applicable laws
• Content removal: We reserve the right to remove any User Content that violates these Terms or applicable law

6. AI Processing

The Service uses third-party AI models to process your images. By using the AI features, you acknowledge and agree that:

• AI processing results may vary and are not guaranteed to be accurate, realistic, or suitable for any particular purpose
• Your images are transmitted to third-party AI services (Replicate) for processing
• CarEditor does not use your images to train AI models
• The Service is provided for creative and personal use and is not suitable for safety-critical or legally binding applications

You must not use the AI features to generate content that is illegal, harmful, defamatory, obscene, fraudulent, or that infringes on the rights of others.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Use automated scripts, bots, or scrapers to access the Service
• Upload illegal, offensive, defamatory, or infringing content
• Resell, sublicense, or transfer your access to the Service to third parties
• Attempt to circumvent payment, authentication, or access control mechanisms
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Use the Service for any purpose that violates applicable local, national, or international law

8. Intellectual Property

The Service, including its design, code, features, logos, and trademarks, is the intellectual property of CarEditor and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Your User Content remains your intellectual property as described in Section 5 above.

10. Dispute Resolution

We want to resolve disputes fairly and efficiently. If you have a concern, please follow these steps:

1. Informal resolution (30 days): Contact us at team@car-editor.com describing your concern. We will work with you to resolve the issue within 30 days.
2. Binding arbitration: If informal resolution fails, the dispute shall be settled by binding arbitration. The arbitration shall be conducted in English using established international arbitration rules.
3. Fallback jurisdiction: If arbitration is not enforceable in your jurisdiction, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Serbia.

Class action waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action, collective action, or representative proceeding.

11. Termination

You may terminate your use of the Service at any time by deleting your account. Upon account deletion, your stored images and personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, without prior notice, if you violate these Terms, engage in unlawful activity, or if we reasonably believe your use of the Service poses a risk to us or other users. Termination does not entitle you to a refund of any prepaid subscription fees, except where required by applicable law.

12. DMCA / Copyright

CarEditor respects intellectual property rights. If you believe that content on the Service infringes your copyright, please submit a takedown notice to team@car-editor.com with the following information:

• Identification of the copyrighted work you claim has been infringed
• Identification of the material you claim is infringing, with enough detail to locate it
• Your contact information (name, address, email, phone)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate
• Your physical or electronic signature

We will investigate and respond to valid takedown notices in accordance with the Digital Millennium Copyright Act (DMCA). Repeat infringers may have their accounts terminated.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. We will make reasonable efforts to notify you of material changes (for example, via a notice on the Service). Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
